Revision of data localization regulation finally made public

The revision of Government Regulation no. 82, 2012 (GR 82 revision) has finally been made public. The revision is now known as Government Regulation no. 71, 2019 Regarding Electronic System and Transaction Operation (GR 71/2019). This further development is welcome news, as industry can finally obtain clarity regarding data localization and management requirements for both the public and private sectors.

The revised regulation has been under discussion for several years and the release of GR 71 was a relief to many in industry.

A quick look at GR 71 indicates that the signed draft is the August draft, as it contains a number of changes that were not in the previous (June) draft. The data classification system is still as written in the previous draft and concerns data controlled by both Public Electronic System Operators and Private Electronic System Operators. It is believed that only Public data, which is held by the government, must be stored locally. However, the draft that was signed contains various specifications about what will be considered “Private” (aka commercial/non-strategic data).

Similar to previous drafts, financial sector data will still be regulated by Bank Indonesia and the Financial Services Authority (OJK) separately.
